Welcome to Backyard Pool AI. These Terms and Conditions (“Terms”) govern your access to and use of the Backyard Pool AI website located at backyardpoolai.com and all related services, features, and tools (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Definitions
- “Backyard Pool AI,” “we,” “us,” or “our” refers to Backyard Pool AI, the operator of backyardpoolai.com.
- “User,” “you,” or “your” refers to any individual or entity that accesses or uses the Service.
- “Input” refers to any photos, images, text, or other content you upload to or provide through the Service.
- “Output” refers to any AI-generated pool design images, renderings, or content produced by the Service based on your Input.
- “Content” refers to Input and Output collectively.
- “Subscription” refers to a recurring paid plan that provides access to the Service on a monthly or annual basis.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, contact us immediately at support@backyardpoolai.com.
4. Service Description
Backyard Pool AI is an AI-powered pool design visualization tool. Users upload a photo of their backyard or outdoor space, and our AI generates realistic images showing various pool designs tailored to the uploaded space. The Service is intended for visualization and planning purposes only. AI-generated designs are not engineering blueprints, construction documents, or architectural plans and should not be used as a substitute for professional pool design, engineering, or construction services.
5. Payment Terms
5.1 Pricing Models
Backyard Pool AI offers multiple ways to access the Service, including one-time payments, monthly or annual subscriptions, and free access with optional paid upgrades. The specific features, pricing, and limitations of each plan are described on our pricing page and may change from time to time.
5.2 Billing
For one-time purchases, payment is charged at the time of purchase. For subscriptions, payment is charged at the beginning of each billing cycle (monthly or annual). Subscription plans automatically renew at the end of each billing period unless you cancel before the renewal date.
5.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period. No partial refunds are provided for unused time within a billing cycle.
5.4 Price Changes
We reserve the right to change our pricing at any time. For active subscribers, we will provide at least 30 days’ notice before any price increase takes effect. The updated pricing will apply to your next billing cycle after the notice period.
5.5 Taxes
All prices are exclusive of applicable taxes. You are responsible for any taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service.
6. Refund Policy
We offer a 7-day refund policy. If you are not satisfied with the Service, you may request a full refund within 7 days of your purchase or the start of your subscription by contacting us at support@backyardpoolai.com. Refund requests made after the 7-day window will not be honored. Refunds are processed using the original payment method and may take 5 to 10 business days to appear on your statement.
7. Ownership of Content
7.1 Your Input
You retain full ownership of any photos, images, or content you upload to the Service. By uploading Input, you represent and warrant that you own or have the necessary rights, licenses, and permissions to use and submit the Input.
7.2 AI-Generated Output
You own all Output generated by the Service based on your Input. Backyard Pool AI claims no ownership rights over your AI-generated pool design images. You are free to use, modify, distribute, and reproduce your Output for any personal or commercial purpose.
7.3 Similarity of Output
Due to the nature of AI technology, it is possible that Output generated for different users may be similar. Our assignment of rights to you does not extend to Output generated for other users.
7.4 Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, and incorporate that feedback into our Service without obligation to you.
8. Acceptable Use
You agree not to use the Service to:
- Upload content that you do not have the right to use, or that infringes the intellectual property or privacy rights of any third party.
- Upload content that is illegal, defamatory, obscene, threatening, or otherwise objectionable.
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying technology of the Service.
- Use automated scripts, bots, or other tools to access the Service in a manner that exceeds normal human usage.
- Resell, sublicense, or redistribute access to the Service without our prior written consent.
- Interfere with or disrupt the integrity or performance of the Service.
- Misrepresent AI-generated Output as professional architectural or engineering work.
9. Intellectual Property
All software, algorithms, models, designs, trademarks, logos, and other intellectual property related to the Service remain the exclusive property of Backyard Pool AI. These Terms do not grant you any rights to use our trademarks, branding, or proprietary technology except as expressly permitted to access and use the Service.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.
11. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, that AI-generated designs will be accurate, complete, or suitable for construction, or that the Service will meet your specific requirements.
AI-generated pool visualizations are for illustrative and planning purposes only. Always consult a licensed pool builder, architect, or engineer before making construction decisions.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Backyard Pool AI and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Backyard Pool AI and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
14.1 By You
You may stop using the Service and close your account at any time by contacting us at support@backyardpoolai.com or through your account settings.
14.2 By Us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if continued access would pose a risk to us or other users.
14.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. Any Output you have previously downloaded remains yours. We are not obligated to retain your Input or account data after termination.
15. Third-Party Services
The Service may contain links to or integrations with third-party websites, services, or tools. We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.
16. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States of America. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. If arbitration is not enforceable in your jurisdiction, disputes shall be subject to the exclusive jurisdiction of the federal and state courts located within the United States.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Backyard Pool AI regarding your use of the Service and supersede all prior agreements or communications.
